These Terms and Conditions ("Terms") govern your use of The Tanpura mobile application (the "App") operated by Harmonic Series ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for personal, non-commercial purposes in accordance with these Terms. You may not sublicense, distribute, modify, reverse-engineer, decompile, or create derivative works from the App.

2. Free Tier & Trial

The App offers the following free access:

  • —Daily Free Playback: 5 minutes of playback per day across all instruments, resetting daily.
  • —Extended Trial: A one-time 72-hour extended trial may be activated from within the App for deeper exploration.

Free tier availability and trial terms are subject to change. We reserve the right to modify, suspend, or discontinue the free tier at any time.

3. Subscriptions & Purchases

Premium features are available through in-app purchases:

  • —Monthly Subscription: $2.99/month, billed monthly. Auto-renews unless cancelled at least 24 hours before the end of the billing period.
  • —Annual Subscription: $19.99/year, billed annually. Auto-renews unless cancelled at least 24 hours before the end of the billing period.
  • —Lifetime Purchase: $49.99 one-time payment. Grants permanent access to all premium features.

All payments are processed through the Apple App Store or Google Play Store. Prices are in USD and may vary by region. Subscription management and cancellation must be done through your app store account settings. Refunds are subject to the respective app store's refund policies.

4. Intellectual Property

All content in the App, including but not limited to audio recordings, software, graphics, icons, text, and the overall design, is the property of Harmonic Series and is protected by copyright, trademark, and other intellectual property laws. The raag presets, tanpura recordings, and audio samples are proprietary and may not be extracted, reproduced, or distributed.

5. Acceptable Use

You agree not to:

  • —Attempt to circumvent the trial timer, subscription verification, or any security measures
  • —Use the App for any unlawful purpose
  • —Reverse-engineer, decompile, or disassemble the App
  • —Redistribute, sell, or commercially exploit the App or its content
  • —Interfere with or disrupt the App's servers or infrastructure

6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARMONIC SERIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

8. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your license to use the App is immediately revoked.

9. Apple & Google App Store Terms

If you access the App through the Apple App Store or Google Play Store, the following additional terms apply:

  • —These Terms are between you and Harmonic Series only, not with Apple Inc. or Google LLC. Harmonic Series, not Apple or Google, is solely responsible for the App and its content.
  • —Harmonic Series, not Apple or Google, is responsible for any maintenance and support services for the App.
  • —In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google for a refund of the purchase price (if any). To the maximum extent permitted by applicable law, Apple and Google have no other warranty obligation with respect to the App.
  • —Harmonic Series, not Apple or Google, is responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, and intellectual property infringement claims.
  • —Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Harmonic Series and its officers, directors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
