These Terms and Conditions ("Terms") govern your use of The Tanpura mobile application (the "App") operated by Harmonic Series Ltd ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal and professional musical use in accordance with these Terms. You may not sublicense, distribute, modify, reverse-engineer, decompile, or create derivative works from the App.

2. Free Tier & Trial

The App offers the following free access:

  • —Daily Free Playback: 5 minutes of playback per day across all instruments, resetting daily.
  • —Extended Trial: A one-time 72-hour extended trial may be activated from within the App for deeper exploration.

Free tier availability and trial terms are subject to change. We reserve the right to modify, suspend, or discontinue the free tier at any time.

3. Purchases

Premium features are unlocked with one-time purchases. There are no subscriptions and no recurring charges — you pay once for what you unlock, and it remains yours.

  • —Tanpura & Swarmandal: a single payment of £12.99 (or the equivalent in your local currency) grants permanent access to all premium features of the Tanpura and Swarmandal instruments, with no further charges for those instruments.
  • —Future content: This purchase grants lifetime access to the Tanpura and Swarmandal package only. Any additional instruments or content we may release in the future are not included and may be made available separately.

All payments are processed through the Apple App Store or Google Play Store. Prices are set in pounds sterling (£) — the Tanpura & Swarmandal package is currently £12.99 — and shown in your local currency at the equivalent amount determined by the respective app store; the exact amount may vary slightly by region and over time. Refunds are subject to the respective app store's refund policies.

4. Intellectual Property

All content in the App, including but not limited to audio recordings, software, graphics, icons, text, and the overall design, is the property of Harmonic Series Ltd and is protected by copyright, trademark, and other intellectual property laws. The raag presets, tanpura recordings, and audio samples are proprietary and may not be extracted, reproduced, or distributed.

5. Acceptable Use

You agree not to:

  • —Attempt to circumvent the trial timer, purchase verification, or any security measures
  • —Use the App for any unlawful purpose
  • —Reverse-engineer, decompile, or disassemble the App
  • —Redistribute, sell, or commercially exploit the App or its content
  • —Interfere with or disrupt the App's servers or infrastructure

6. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HARMONIC SERIES LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, or for fraud — and your statutory rights as a consumer are not affected.

8. Termination

We may suspend or restrict access to online or server-dependent features (such as trial activation and over-the-air updates), and may remove the App from distribution, where we reasonably believe these Terms have been breached. Where you have purchased the App, this does not affect your statutory consumer rights, and any refund of a purchase is handled by the Apple App Store or Google Play in accordance with their policies.

9. App Store Terms

The App is distributed through the Apple App Store and Google Play Store. The following additional terms apply to your use of the App:

  • —These Terms are between you and Harmonic Series Ltd only, not with Apple Inc. or Google LLC. Harmonic Series Ltd, not Apple or Google, is solely responsible for the App and its content.
  • —Harmonic Series Ltd, not Apple or Google, is responsible for any maintenance and support services for the App.
  • —In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google for a refund of the purchase price (if any). To the maximum extent permitted by applicable law, Apple and Google have no other warranty obligation with respect to the App.
  • —Harmonic Series Ltd, not Apple or Google, is responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, and intellectual property infringement claims.
  • —Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.

10. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Harmonic Series Ltd from any claims, damages, losses, and reasonable expenses arising out of your misuse of the App, your breach of these Terms, or your infringement of a third party's rights. This does not apply to the extent any loss results from our own breach, negligence, or wrongdoing, and nothing in this section affects your statutory rights as a consumer.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms, and any dispute arising out of or in connection with them, are governed by the laws of England and Wales. If you are a consumer, you will also benefit from any mandatory provisions of the law of the country in which you are resident, and nothing in these Terms affects your rights as a consumer to rely on those mandatory provisions.

The courts of England and Wales will have jurisdiction over any dispute. However, if you are a consumer resident in another country, you may also bring proceedings in your country of residence, and you may be sued only in the courts of your country of residence where the mandatory law of that country so requires.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.
